Wall Street closes out best first quarter in 14 years

Wall Street sees dramatic gains for indexes in first quarter of 2012: Dow climbs 8 percent; S&P rises 12 percent; Nasdaq is up 19 percent. ?

Rising consumer spending boosted U.S.?stocks?on Friday, and Wall Street closed its best first quarter since 1998.

The Dow Jones industrial average rose 66.22 points to close at 13,212.04. The Standard & Poor's 500 index rose 5.19 points to close at 1,408.47. The Nasdaq composite barely moved, falling 3.79 points to close at 3,091.57.

For the quarter, the Dow posted an 8 percent gain and the S&P a 12 percent gain, the best for those indexes in 14 years. The gain was 19 percent for the Nasdaq, its best since 1991.

The Commerce Department said consumer spending rose in February at the fastest rate in seven months. Strong hiring over the past three months has added up to the best jobs growth in two years, putting more people back to work.

Americans spent more even though their income has stagnated for two months after taxes and inflation. Some of the increased spending has gone to gasoline, which is the most expensive on record for this time of year. Oil prices rose again on Friday, up 23 cents in New York to $103.02 per barrel.

Nine out of 10 industry groups in the S&P 500 rose. The biggest-gaining category was energy?stocks, although refiners fell because of the higher oil prices. Health care?stocks?rose, too, with two of the biggest gainers being health insurers UnitedHealth Group Inc. and WellPoint Inc. Technology?stocks?fell slightly.

Some of the buying could be driven by end-of-the-quarter efforts by fund managers to get into?stocks?now that they have become popular again, said Jim Russell, a regional investment director for US Bank Wealth Management. And individual investors who have been relying on bonds appear to be getting back into the market, too, he said.

"We are very heartened to see the retail investor stop playing one key on the piano ? that is, all bonds, all the time," he said.

Apple fell 1.7 percent after a company that makes its iPhones and iPads said it would effectively raise per-hour wages at its factories in China, suggesting that manufacturing prices could rise.

Shares of BlackBerry maker Research in Motion Ltd. rose 6.6 percent a day after the Canadian company said it would return to focusing on corporate customers and shake up its management to try to get profits growing again.

Corn prices surged 6.6 percent on news that suppliers are tighter than previously thought. Higher corn plus higher oil prices points toward higher food prices. Grocer?stocks?fell: Supervalu Inc. was down 3.7 percent, and Safeway Inc. fell 1.3 percent.

Best Buy closed down 4.4 percent as investors continued to digest its plan to cut stores and staff as it shifts toward smaller stores in an effort to compete with online retailers. Best Buy?stock?lost almost 7 percent on Thursday.

Sports apparel maker Finish Line Inc. fell 16 percent after it predicted a lower-than-expected first-quarter profit.

European markets bounced back after a rocky week that included a national strike in Spain. On Friday, the country unveiled a draft 2012 budget that seeks to cut the deficit by $36 billion through spending cuts and a tax hike on large companies. But Spain also plans to cut government ministry spending by an average of nearly 17 percent.

Germany's DAX closed up 1 percent at 6,947, while the CAC-40 in France rose 1.3 percent to 3,424. The FTSE 100 index of leading British shares was up 0.5 percent to 5,768. The euro rose half a penny against the dollar, to $1.3334.

Asian markets took a hit after some poor factory production numbers from Japan.

The yield on the benchmark 10-year U.S. Treasury note rose to 2.22 percent from 2.16 percent late Thursday. Treasury yields have risen two months in a row as investors feel more comfortable moving out of bonds and into riskier assets like?stocks.

Dating Violence Common by 7th Grade: Survey - Domestic Violence ...

HealthDay News
by By Alan Mozes

new article illustration

THURSDAY, March 29 (HealthDay News) -- Psychological and physical abuse is a common facet of dating for America's adolescents, a new survey reveals.

Researchers who polled more than 1,400 seventh graders found that more than 37 percent of 11- to 14-year olds had been the victim of some form of psychological violence, and almost one in six said they had fallen prey to physical violence while in an ongoing relationship.

"Issues of dating abuse among young teens are much more pervasive than I imagine many families believe," said Peter Long, president and CEO of Blue Shield of California Foundation, which co-sponsored the survey with the Robert Wood Johnson Foundation and the organization Futures Without Violence.

Long said he was startled to see that three-quarters of the students reported they had a boyfriend or girlfriend by their middle-school years.

"That's a big number, and it means that this is the age when many kids are forming their views of what it is to have a relationship," Long said. This indicates that this is the appropriate age to intervene, he added, saying, "High school may even be too late."

The finding that 31 percent of these middle school kids is "experiencing some kind of electronic aggression or pressure such as provocative or insistent texting should be a warning sign for us," Long said, "as is the fact that 15 percent have experienced some kind of physical abuse while dating."

According to U.S. Centers for Disease Control and Prevention questionnaires, 10 percent of American high school students say they have been physically abused by their boyfriend or girlfriend. But clear insight regarding younger teens has been less well investigated, the researchers said.

To address that issue, between 2010 and 2012 surveys were conducted in eight middle schools in five U.S. cities: Los Angeles; Bridgeport, Conn.; Indianapolis; San Diego, and Saginaw, Mich.

The average age of the 1,430 students polled was 12, and boys and girls were equally represented. About one-quarter were white; 30 percent, black; 34 percent, Hispanic and 12 percent were a combination of other races.

The survey defined teen dating violence as any form of physical, sexual or emotional violence occurring within the context of dating. Psychological violence includes controlling behaviors, such as not allowing a girlfriend or boyfriend to do things with other people. Electronic violence covers bullying and name-calling online or via texts, and physical violence includes pushing, grabbing or kicking one's partner.

Asked about these and other behaviors in the previous six months:

  • Thirty-seven percent said that they had seen boys or girls being physically abusive towards their dating partner. About one-quarter had a male or female friend who was physically violent to a partner, and more than 20 percent had a friend whose partner was physically violent to him or her.
  • Forty-nine percent said they had been sexually harassed, either physically or verbally, by being touched inappropriately or joked about.
  • Seven percent strongly agreed that it was okay for a boy to hit his girlfriend under certain circumstances, such as "a girl who makes her boyfriend jealous on purpose." Interestingly, 50 percent strongly agreed that it was OK for a girl to hit her boyfriend in the same siutation.
  • Sixty-three percent agreed with what the pollsters considered a "harmful stereotype" about gender, such as "girls are always trying to get boys to do what they want" or "With boyfriends and girlfriends, boys should be smarter than girls."

"But the good news," Long said, "is that nearly three-quarters of the students reported that in the last six months they have talked to their parents about dating. Not necessarily about dating abuse, but about dating. Which means the door is open for parents to talk to their children about relationships. So, on the one hand we have real serious issues here. But, on the other hand, we also have a real opportunity for parents to engage."

A California mother of two, Alexandra Preston, 35, encourages parents of teens to take the survey findings to heart.

"There's a tendency to read about a study like this and think, 'That can't be true.' Because we want our kids to be safe and happy, and we don't want it to be true, right?"

"But I think it's important that parents acknowledge that understanding and establishing and respecting boundaries is something all of us have to struggle with throughout life, at every age," said Preston, who added that she herself was a victim of domestic violence in a prior marriage.

Preston, whose children are 13 and 10, is finance and operations manager for a non-profit agency that works with Robert Wood Johnson's Start Strong program, which aims to combat dating abuse in middle school. She said her own experiences have led her to be proactive with her children regarding healthy relationships.

Her son "remembers what happened in our home," she said, explaining she tries "to make sense of it, without demonizing the people who do it, and making sure they know it's not their fault."

Preston said this study could be helpful in raising awareness about dating issues, and encouraging parents to listen to their children.

Soon after new homes arrive on sales lots, they leave for site placement. The sales manager for one business told the reporter sales have tripled in the past year, most destined for the western part of the state. The task of setting the homes is being outsourced to companies in Montana and elsewhere just to keep up with demand. Used homes are apparently difficult to find and afford.

Dell calls it quits in US smartphone market

Dell is getting out of the smartphone business in the United States -- wait, you mean you didn't know they were in it?

Let's put it this way: Dell entered the U.S. smartphone market quite late with the Aero (at left), launched in summer of 2010. Now, the company is getting out early, before spending more time and money on their poor-selling Android- and Windows-based devices. Dell's latest models, the Venue Pro (Windows) and Venue (Android) will not be sold any longer in the U.S. They will continue to be sold overseas.

"Mobility products typically have shorter lifecycles than laptops and desktops, and we have decided to no longer offer those two on Dell.com in the United States," said a Dell spokesperson in a statement to msnbc.com.

Jack Gold, principal analyst at J. Gold Associates, told?PCWorld?that Dell's move is probably a good one, and that it may allow the company to better focus on other products, such as tablets that use Windows 8, expected out this fall.

Android phones from Samsung, HTC and Motorola have done very well, and a Nielsen report Thursday says that?49.7 percent of U.S. mobile subscribers owned smartphones as of February, up from 36 percent a year ago.?Android-based phones lead the U.S. smartphone market with a 48 percent share, while Apple's iPhone is at 32 percent, and BlackBerry is at 11.6 percent.

Dell's smartphone appeal has not been domestic. The Texas-based company began selling phones first in countries like Brazil and China before the U.S.?

In the U.S. the company's 5-inch Streak smartphone and tablet did get some positive feedback, and Samsung has gone a similar size route with its Galaxy Note.

Dell's larger Streak tablet hasn't been on a selling streak -- especially compared to other offerings from Apple, Samsung and Amazon.com's Kindle Fire -- but with touch-oriented Windows 8, Dell may be able to better compete in the U.S. tablet market.

The company's decision doesn't preclude it from trying at smartphones again domestically.?"We're looking forward to offering new products and concentrating on expanding our growing mobility solutions portfolio in the future," Dell said in its statement.

Car auctioneer offers tips for used car buyers | Autoliquidator News

When it comes to used cars, most buyers will be visiting an auto dealer in order to make their purchase. However, some shoppers may be aware that the best bargains tend to come from used car auctions. Although not typically advertised publicly, these auctions are where dealers go to find cars to resell later.

This can make auctions sound very appealing for a used car buyer. Why not just cut out the middleman and buy directly from an auction? There are a few reasons. For starters, many auctions are closed to anyone who is not a dealer, and public auctions are somewhat rare. The other major reason is that there are quite a few lemons present at these auctions that could cause an inexperienced buyer to get into trouble very quickly.

The automotive research website Edmunds recently posted an article entitled "Confessions of an Auto Auctioneer." The former auctioneer, Steve Lang, gave buyers some things to watch out for if they do plan on braving an auction setting in search of a bargain.

"This is a world that average car buyers enter at their own peril," said Lang. "While there are bargains to be had, there?s plenty of potential for disaster, too. If you are not a mechanically inclined person with a keen eye, buying a car at a public auction is not for you."

For example, Lang says it's important to know who you're buying from. The best sellers are banks and financial institutions. These groups have come into the car through repossession and just want it off their hands. They're not in the car business, so they're not likely to pull a fast one.

New car dealers are the next step down. These vehicles are likely trade-ins that the dealer doesn't want to go through the hassle of selling. Typically, these cars might have problems that will need repairing, and the dealer simply doesn't want to invest in the car. However, you're generally not going to find cars in need of major repairs, as the vast majority of new car dealers will not take those automobiles as a trade to begin with.

Used car dealers are the type of buyer that drivers should avoid at auctions. There's nothing wrong with buying from a used car dealer on the lot, but if the car is at an auction, it means they haven't been able to sell it either on their own lot or at a dealer auction. Typically this indicates major problems with the car that the dealer might be attempting to hide.

What you do before the auction matters as well. Most auctions will post the Vehicle Identification Numbers (VINs) online ahead of time. This allows interested bidders to use a service like CarFax and get a full history report that will illuminate any problems. Popular Mechanics also recommends that buyers check the various parts of the car to ensure that it doesn't have different VIN numbers. Good places to look are the trunk and the door. If the VIN number doesn't match up, the car was likely in a wreck and has since been rebuilt. Be sure to look up the value of the car as well and set a price limit for yourself so you don't overbid.

On the day of the auction, it pays to show up early, according to Lang. Many auctions will allow the bidders to get a look under the hood and possibly even test drive a car before they buy. This is also a chance to help narrow down the cars that you want to bid on. It's important to stick to the price limits that you set ahead of time and not overbid simply because you want a car.

Happy 26th birthday to Lady Gaga!

Daniel Roland / AFP - Getty Images

By Natalie Finn, E! Online

You're on the right track, babies, Lady Gaga was born on this day!

Happy birthday to the pop superstar, who, with more than 23 million albums sold and five Grammys, is mighty accomplished for any age, let alone the tender age of 26.

While Gaga -- aka Stefani Germanotta from NYC -- has carefully crafted an always-on image and cultivated one of the most loyal fan bases in music, she hasn't been devoured by the fame monster.

Instead, she has used her celebrity to advocate for AIDS education and gay rights and, most recently, she launched the Born This Way Foundation to combat bullying and other alienating social constructs that affect young people.

Not to mention, in the past few years she's managed to hatch from a giant egg, wear meat and stuffed frogs, single-handedly support the wig industry, and add at least 12 inches to her slight frame with gravity-defying boots.

GALLERY: Lady Gaga's Top 10 Red Carpet Moments

Feel free to go all-out for a change on your birthday, Gaga. You've earned it.

What's your favorite Gaga moment? The music? The meat dress? The egg? Let's talk over on Facebook.

Angry Birds Space billed as an educational tool. Really?

Launched Thursday, Angry Birds Space, the latest installment to the wildly popular Angry Birds video game franchise, is being billed as a tool for educating people about physics. How scientifically accurate is the physics in the game?

With over 700 million downloads,?the first Angry Birds game is a testament to the appeal of simplicity. The much-anticipated sequel, Angry Birds Space, which launched on Thursday, looks just as simple, and as freakishly enjoyable.?

But there is one big difference between the original and its high-flying sequel: Angry Birds Space is being billed?as a tool for educating people about physics.

The original Angry Birds allows players to slingshot a variety of ornery avians at oblate green pigs. The pigs have absconded with birds' eggs, hence their anger.

Angry Birds Space incorporates an element of interplanetary gravity. The developers collaborated with NASA to "teach people about physics and space exploration through the internationally successful puzzle game," according to NASA's recent press release.

Peter Vesterbacka, the chief marketing officer of Rovio, which made the game, said in the release that the company couldn't "wait to work with [NASA] on creating more compelling educational experiences."

NASA and Rovio aren't the only organizations touting Angry Birds Space as an educational tool. The Examiner, InformationWeek, and other media outlets have described the game in much the same way.

But is that really true? Is there any educational value in Angry Birds Space??

Before we explore this question, though, let's admit that Angry Birds Space is a game, foremost, and a fun one at that. Perhaps there doesn't have to be any more of a justification to play it, and maybe the excuse of educational value is?unnecessary.

And let's give credit where it's due. The claim that the new game appropriates the concept of microgravity ? the kind of low gravity that affects objects in orbit, like at the International Space Station ? is pretty much true. Also, the game illustrates how objects ? in this case, the birds ? launched in a straight line will curve their trajectories in the presence of massive bodies. So far, so good.?

But when you add audible TNT detonations in space, plants subsisting without carbon dioxide on otherwise forlorn moons, an inexplicable presence of wood and concrete, and the stormy purple vortex at the stroyline's beginning, the educational value of the game falls off dramatically.

The game exhibits more serious problems too, namely, physical impossibilities. Rhett Allain, Associate Professor of Physics at Southeastern Louisiana University and Blogger for wired.com, pointed some of these out.

In the game, the slung birds enter the gravitational fields of tiny pocked moons and plummet toward them. According to Newton's Law of Gravitation, the moons must be extremely massive in order for the birds to move as fast as they do. But the moons aren't all that much larger than the birds themselves. This means that they would have to be extremely dense. Allain calculates one moon's density to be about 7 billion kg/m3 , closer to the density of a white dwarf than that of a moon.

Also, if the moons had real gravity, then all objects caught in their fields ? which in the game are portrayed as glowing pellucid disks ? would accelerate towards the surface. It's hard to say if the birds follow this law, since they go through so many other inexplicable motions. But the debris they collide with clearly do not. Allain demonstrated that in the game, rocks actually slow down during their free-fall to the moons' surfaces.

And why are those moons sitting still, exactly? In space, they would not only gravitationally interact with the wayward birds, but also with each other. If intentional, it was clever for the developers of Angry Birds Space to?lock the moons in place. The conundrum of three or more bodies gravitating towards one another still perplexes physicists. They call it the n-body problem. Obviously, n-body gravitation occurs, but we have no way to theoretically explain it. Even the current models that can approximate this motion are astoundingly math-intensive.?

Criticizing an extremely fun and successful video game for its inaccuracy is easy, if not curmudgeonly. But if you're going to look to Angry Birds Space for educational value, you should know that its physics is about as accurate as its ornithology.?

The very first thing you need to do is get hold of the correct authorization to seize the pc with a view to have entry to it is' components. This consists of hardware, software, server, storage media and files. After authorization has been given, the next step can be to organize for the collection of evidence. This includes sterilizing all media and equipment which might be used in the examination course of, making certain your software is properly licensed for use, and to verify all the pieces within the laboratory is in working situation (Thomas Impolite, 2000).

After every part is prepped to go, as you enter the scene, you may need to carefully document and take note of the crime scene. After the evidence is delivered to the laboratory, it is time to prep for examination. A computer forensics individual have to be fairly adept with technical skills. To be employed in this place, you may have to know learn how to?online payday loans perform backups with out altering the hard drive content. A part of this is to mirror what's on the drive and find out how to appropriately use the technical tools to achieve this. Next would come the precise examination of the pc and it's components.

Louisiana primary: Last chance for Rick Santorum to stay viable in the race?

Polls show that Rick Santorum is headed for a ?commanding win? in Saturday's Louisiana primary. But front-runner Mitt Romney is likely to pick up delegates as well.

Louisiana Republicans go to the polls Saturday, giving Rick Santorum what may be his last best chance to stay a viable candidate in the GOP presidential primaries.

It?s become essentially a two-man race, with Mitt Romney way ahead in the delegate count and Newt Gingrich and Ron Paul hanging on but with no hope of winning the nomination.

Yet Mr. Romney has not won a single Southern state, aside from Virginia (where neither Messrs. Santorum nor Gingrich qualified for the ballot) and Florida (which is not a classic Southern state). And in two key states he did win ? Florida and Illinois ? he lost those parts of the states that are most like the South.

Thus going into the Louisiana primary, Santorum seems to have a solid edge.

A Rasmussen Reports poll taken Wednesday has Santorum ahead of Romney by a comfortable 12 points (43 to 31 percent, with Gingrich trailing a distant third with 16 points and Representative Paul way back at 5).

Other surveys echo those results.

?Rick Santorum is headed for a commanding win in Louisiana on Saturday,? declares Public Policy Polling, based on its survey taken Wednesday and Thursday. ?We find him with 42 percent to 28 percent for Mitt Romney, 18 percent for Newt Gingrich, 8 percent for Ron Paul, and 2 percent for Buddy Roemer.?

What?s more, PPP finds, ?conservative voters appear to be abandoning Gingrich for Santorum.? With Gingrich out of the race, ?Santorum would have a 22 point lead, 53-31, over Romney here with Paul at 11%.?

Polls by Magellan Strategies and the?American Research Group give Santorum a double-digit lead as well.

As has been the case in previous primaries and caucuses, Romney holds his own in urban and suburban areas of Louisiana, but falls way behind in rural areas as well as among tea partyers, Evangelicals, and Republicans who identify themselves as ?very conservative.?

"We think we're going to do well here," Santorum told the Associated Press. ?This state,... of all the states in the Deep South, I think matches up with us well. It's a very conservative state.?

He added, "We're going to do better even than Mississippi and Alabama.?

On that point, Romney seems to agree. He has not campaigned much in Louisiana or spent much on television ads there, and he seems to be conceding the state to Santorum.

"We hope to do well wherever we are on the ballot, but we know we aren't going to win everywhere,? Romney spokeswoman Gail Gitcho told the AP. ?We are hoping to pull as many delegates as we can out of Louisiana.?

Romney could continue to add delegates under Louisiana?s proportional distribution. Only 20 of the state?s 46 delegates will be chosen in Saturday?s primary, divvied up among any candidates who receive at least 25 percent of the vote. The rest will be chosen at a state party convention, going uncommitted to the GOP convention in Tampa, Fla. (which means they could join a Romney bandwagon).

Romney heads into Saturday?s Louisiana primary with notable support from two important party figures.

Former Florida governor Jeb Bush, representing establishment Republicans, formally endorsed Romney.

Perhaps more significant, Sen. Jim DeMint (R) of South Carolina ? the closest thing to a tea party leader in Congress ? had very positive things to say about Romney this week.

"I am not only comfortable with Romney; I'm excited about the possibility of him possibly being our nominee,? he told reporters. ?His leadership skills, the fact he hasn't lived in his life in Washington ? there is a lot to like there."

Meanwhile, Gallup reported Friday, Romney's national support among Republican voters ?has surged in recent days.?

Gallup?s daily tracking poll has Romney at 40 percent ? 14 points ahead of Santorum?s 26 points. It's the first time a candidate has reached this level in the campaign.

?With a more substantial lead in preferences, the coming days will reveal whether Republicans finally coalesce around Romney as their preferred nominee, or whether the campaign takes another turn and weakens his front-runner status,? writes Jeffrey M. Jones of Gallup.

Louisiana will help answer that question. For Santorum, it?s a chance to strengthen his position before the campaign moves into April with a slew of primaries in the North, where (except for his home state of Pennsylvania, perhaps) it?s likely to be a harder fight for him.

So far, Romney has accumulated 563 convention delegates ? more than Santorum, Gingrich, and Paul combined (448). But he still needs 581 to reach the 1,144 necessary to win the nomination.

Rangers hope for new owners by end of season

Associated Press Sports

updated 10:49 a.m. ET March 25, 2012

GLASGOW, Scotland (AP) -Administrators controlling Rangers are looking to secure new owners by the end of the season after receiving five bids for the financially stricken Scottish club.

Offers have been made by the "Blue Knights" consortium run by former director Paul Murray, the owner of English rugby union side Sale Sharks and three other bidders, two of whom are reported to be Chicago-based Club 9 Sports and a Singapore-based consortium.

Paul Clark, Rangers' joint administrator, says a shortlist of "two or three bidders" could be drawn next week.

Clark says Sunday he wants "somebody else to be in control of the football club other than us by the end of the season."

Rangers was forced to seek bankruptcy protection after a long-running dispute with tax authorities.

On Love & Relationships ? Ask Dr. Darcy

Welcome to Format Free Fridays at AskDrDarcy.com, the one day a week when I break the format of answering your questions and I dispense that which we rarely welcome in life: Unsolicited advice.

Today I?m focused on love and relationships, perhaps because as you read this, I?m flying out of town, away from my love and my relationship.? Distance always provides me with a ton of information about myself, how grown up (or developmentally arrested) I am, and where I fall on the codependent spectrum.? Make no mistake about it:? In my last marriage, I wouldn?t have gotten on a plane without my spouse if it meant saving my life.? I vividly recall turning to my couple?s counselor and declaring, I?m perfectly content with being codependent. How she controlled the urge not to smack me I?ll never know.? And in the event that any of my clients are reading this, know that I wouldn?t employ that restraint were those words to come out of your mouth in my office.

My concept of love has changed over the years. I used to associate physical proximity with love.? I believed that the more I was loved, the more time my partner ?should? spend with me. This of course resulted in me attracting and being attracted to someone who was a workaholic and who I saw less than an hour a day for the vast majority of the time we lived together.? Relationships are interesting like that ? they are mirrors of our own personal development (or lack thereof). We will attract someone who will stir up our issues, make us come face-to-face with our deepest fears, and ultimately give us an opportunity to grow like no other human experience.

Perhaps the most profound thing I?ve learned over the years, both professionally and through my own relationships, is that love doesn?t make us happy. People don?t make us happy. We make us happy. We enter relationships hoping to be completed but what we attract is a version of ourselves so if we?re unhappy, the person who we attract is going to reinforce our unhappiness.? If we?re insecure, the person who we?re in a relationship with will provoke our insecurities.

A friend once told me, Two halves don?t make a whole, Darcy. No person can complete you. 17 years later, I espouse this same sentiment day after day in my office, hoping beyond hope that it doesn?t take my clients as long as it took me to learn this.? And of course, life being what it is, it probably will.

Woman admits faking mental illness to avoid jury duty; now charged with perjury

What was once merely a gag on the television comedy "30 Rock" has become a reality, after a Denver woman faked a mental illness to avoid jury duty.

Denver's 9News reports that Susan Cole, 57, faces charges of perjury after she admitted to faking the mental illness during an interview with a? local talk-radio show. "I am embarrassed I did it. I didn't mean to harm the judge. I really felt bad she interpreted this," Cole said, after admitting she "deliberately dressed in a disheveled and uncoordinated fashion," and was excused from jury duty in July 2011.

But Cole's deception went beyond merely wearing mismatched clothes. And the evidence suggests she hasn't stopped lying to authorities. Cole also told the court she was suffering from PTSD. "I broke out of domestic violence in the military. And I have a lot of repercussions. One is post-traumatic stress disorder," the court reporter's records show Cole saying. "My military records are now missing. I have lived on the street, and I have worked myself up to living with my cousin."

Cole then recounted her hoax during an October 17, 2011, interview on the Dave Logan Show. Ironically, the judge Cole had lied to about her condition was listening to the program when Cole explained what she had done. Cole has since admitted lying to the judge but attempted to explain her motivation for lying by saying she slept in late during the day she was scheduled to appear in court and was "distraught" over a motorcycle accident that had recently occurred near her home. She also claims to actually be suffering from PTSD from both an "abusive marriage" and her previous alleged traumatic military experience. The U.S. Army says it has no records verifying Cole's claims. And Cole's divorce records reportedly do not contain any evidence, or even allegations, of physical or mental abuse

"The defense will have to show that she did not knowingly lie about a material fact. Bragging about getting out of jury duty is a little bit like being proud of not voting or cheating on your taxes," 9News Legal Analyst Scott Robinson told the station.

Sarkozy announces crackdown on Internet hate sites

President Nicolas Sarkozy said on Thursday that France would make it a crime to consult websites that advocate terrorism or hate crimes and would toughen a crackdown on people who went abroad for ideological indoctrination.

"From now on, any person who habitually consults websites that advocate terrorism or that call for hatred and violence will be criminally punished," Sarkozy said in a televised address after police shot dead an al Qaeda-inspired gunman who had killed seven people.

"France will not tolerate forced recruitment or ideological indoctrination on its soil," Sarkozy said, adding that an enquiry would be launched into whether prisons were being used to propagate extremism in France.

Student sentenced for racial abuse on Twitter

Associated Press Sports

updated 1:10 p.m. ET March 21, 2012

LONDON (AP) -A law student who racially abused former England striker Stan Collymore on Twitter has been ordered to do 240 hours of unpaid community service and pay 150 pounds ($238) in legal costs.

Joshua Cryer was spared a jail sentence after pleading guilty to a charge of sending grossly offensive messages to Collymore, who is now a radio commentator and newspaper columnist.

District Judge Stephen Earl ordered the 21-year-old Cryer to complete the unpaid work over two years.

Former Liverpool and Nottingham Forest striker Collymore reported the abuse to police in January.

Collymore, who also acted alongside Sharon Stone in Basic Instinct 2, says on Twitter that he thanked police "for their professionalism in dealing with this case."

Secondhand smoke again tied to asthma in kids

NEW YORK (Reuters Health) - A fresh look at past studies suggests kids who live with a smoker are more likely to wheeze or get asthma, providing more evidence for the link between secondhand smoke and breathing problems.

Researchers found that the biggest effect on wheeze and asthma symptoms was seen in babies and toddlers whose moms smoked while they were pregnant or soon after kids were born.

The findings don't prove that secondhand smoke caused kids to get asthma, but they add to other research suggesting smoke exposure may trigger respiratory problems in youngsters, researchers said.

"What this really clearly demonstrates is that the research and data documenting the adverse effects of tobacco smoke exposure on children's asthma is very strong," said Dr. Harold J. Farber, who studies smoking exposure and asthma at Baylor College of Medicine and Texas Children's Hospital in Houston.

He said kids' lungs may be weaker when they're exposed to smoke in the womb, and asthma drugs may not work as well in those children.

"Eliminating our children's tobacco exposure has got to be a critical public health priority," Farber, who wasn't involved in the report, told Reuters Health.

Researchers from the UK analyzed more than 70 studies published between 1997 and 2011, all of which asked about smoking by parents or other household members and then tracked which kids were diagnosed with wheezing or asthma going forward.

Those studies showed that when moms smoked while they were pregnant, their kids were 28 to 52 percent more likely to wheeze, depending on the age they were assessed. The effect on asthma symptoms was greatest in babies and toddlers, who were 85 percent more likely to have asthma if they were exposed to smoke in the womb.

When moms or non-parent household members smoked, kids had up to a 70 percent higher chance of wheezing through age four, but the link to full-on asthma was less clear. The effect of maternal smoking was weakest in kids age five to 18.

There was limited data on how smoking by dads affected kids' chances of wheezing or getting asthma, according to findings published Monday in Pediatrics.

Tricia McKeever from the University of Nottingham and her colleagues said their findings suggest that secondhand smoke has more of an influence on wheeze and asthma than researchers had previously estimated.

"Before, (secondhand smoke) was known as triggering an attack or exacerbating asthma," said Geoffrey Fong, a tobacco researcher from the University of Waterloo in Canada.

"This study shows that secondhand smoke may cause the development of asthma," and not just trigger attacks in kids who already have it, said Fong, who wasn't involved in the new study.

According to the Centers for Disease Control and Prevention, about nine percent of U.S. kids have asthma.

Dr. Serpil Erzurum, an asthma researcher from the Cleveland Clinic, told Reuters Health the research provides more evidence that the development of asthma is based both on genetic predisposition and environmental exposure in the womb and early in life.

"This is very strong exposure that's still going on a daily basis despite all that we know about smoking," said Erzurum, who wasn't tied to the new work.

The study is "a further reminder of the importance of smoke-free laws and smoke-free homes to protect non-smokers, especially children," Fong told Reuters Health.

94% Once Upon a Time in Anatolia

Film critic Molly Haskell famously described 'The Godfather' as "grandly mournful," a beautifully apt description. 'Once Upon a Time in Anatolia' is just as mournful but without the grandeur -- and without a story. It beats me why 'Anatolia' took second prize at Cannes last year. But 2011 was a tough year in general for Cannes. Top prize went to "The Tree of Life," which in my view was run-of-the-mill Buddhism tarted up with kaleidoscopic visuals. In my review of 'Tree,' I described it as a bloated over-statement. I'd describe 'Anatolia' as a bloated non-statement. If it can be imagined, 'Anatolia' has even fewer ideas than 'Tree.' And Cannes was all aflutter over these two films? It must have been a very undistinguished group of films in competition last year. 'Anatolia' is a long, slow, boring dirge. Turkish filmmaker Nuri Ceylan, who has a very good reputation among serious cinephiles (but this is the first Ceylan film I have seen), takes a bunch of middle-aged male actors out to the remote, frighteningly barren countryside of Turkey in the middle of the night and follows them around with his camera as they amble about in a sleep-deprived stupor. They are playing policemen on a murder investigation. Why they are conducting an investigation in the middle of the night is never explained. Their caravan of broken-down vehicles pulls up to one barren location after the next, and all the men look around the ground for clues. Most of them are overweight, semi-educated imbeciles -- peasants with a high school diploma. The only one with real intelligence is a doctor, who inexplicably is along for the ride. That doctor becomes the heart of the movie, and gradually he does emerge as a slightly interesting character. But only slightly. He, like all the other characters, has nothing to do, so his character can only be contemplated in the abstract. In the last half-hour of this overly long film (two-and-a-half hours), I started to feel that Ceylan was a true artist. Probably only a minor one, but a true one. He does have something mournful to say about life and about people that is genuinely artistic. I just don't think he captured his artistic viewpoint very effectively here, either in the writing of the script or the directing of the film shoot. The cinematography, art direction, and editing is consistently pedestrian. My hunch is that he consciously chose a flat style -- flat neo-realist style is very popular in high-art cinema these days (see also Iran's "A Separation," which has become such an art-house hit in America and is likely to win the Oscar for Best Foreign Film). But I don't think it served Ceylan's purpose at all. I can appreciate that he wanted to portray his characters as mind-numbingly boring and flat. But when the man behind the camera starts to seem mind-numbingly boring and flat, something has gone wrong -- at least for me.

Drilling for Oil in Eden: Initiative to Save Amazon Rainforest in Ecuador is Uncertain

Quito, Ecuador? The most biologically diverse habitat in the western hemisphere, the Yasun? rainforest in Ecuador, is under threat. The diversity of species in the Yasun? Park is unmatched by any other park in the world. One hectare contains more species of trees than all of North America, but hidden beneath this Garden of Eden lies temptation: oil worth billions.

Ecuadorian president Rafael Correa is bargaining the fate of the Yasun? Park against the willingness of the industrialized world to pay 3.6 billion dollars in return for a promise not to extract oil from the ecological preserve. The conservation proposal is praised internationally as a creative way to protect the Amazon rainforest and the indigenous people living there, but the fate of the Yasun? Initiative is in doubt. There is uncertainty whether the funding can be raised as governments grapple with the international economic crisis, and skeptics question whether the bargain could work.

?They are going to drill. They are going to drill,? an authority on the Yasun? project told me in confidence. ?Perhaps ten years from now, perhaps 5 years from now. The next president will need that money.?

Oil is Ecuador?s top export, providing one third of its revenue, but despite the black gold pooled beneath its steamy jungles, Ecuador is a poor country. With little industry, Ecuador?s 58.9 billion GDP is among the smallest in Latin America. (By comparison, the GDP of the USA is 14,600 billion.) Exporting raw materials, primarily petroleum, bananas, and shrimp, has enriched foreign corporations, but the wealth has not trickled down to the people. 50 % of Ecuadorian citizens live below the poverty level. One third of the children in Ecuador are malnourished and 60 % in the indigenous populations according to Health Minister, Carina Vance. Between 1999 and 2000 one million Ecuadorians fled their homeland to escape the misery and financial collapse that left the country?s currency worthless. The US dollar is now the accepted currency.

?At some point conservation and ecology are kind of a luxurious thing. People have to eat,? says Prof. Hugo Navarrete, a Biologist at the Pontifica Universidad Cat?lica del Ecuador, describing the situation from the point of view of those who would benefit from drilling.

Poverty and development are wreaking ecological havoc throughout the small country, which is blessed with an astonishing range of rich habitats from the lush Amazon jungle, and the high Andes Mountains, to the Pacific Coast including the Gal?pagos Islands, world renowned as a biological treasure. Shrimp farmers have contributed to the destruction of more than 65 percent of Ecuador?s mangrove habitat to build aquaculture ponds. The mangrove ecosystem cannot fully recover for more than 100 years after being cut. Waste water tainted with chemicals and antibiotics from the farms and pesticide runoff from fumigating banana plantations pollute water sources. An estimated 300,000 sharks are killed per year in Ecuadorian waters, when the taking of shark fins is condemned in most countries.

?The president cares about the money, not conservation. Conservation is not his top concern now. Economic output is his priority,? says an Ecuadorian graduate student, who asked not to be identified.

Elected in 2006, Socialist Rafael Correa pushed through a new constitution (the 20th in this turbulent country since 1830) giving the government great power over the legislature, judiciary and economy. Following the example of his avowed comrade, Hugo Chavez of Venezuela, Correa instituted state control of the independent press. Libel that offends the President caries a prison sentence of up to two years. Journalists have been arrested, including those reporting on environmental issues. Relations between the US and Ecuadorian governments have chilled as Correa is severing ties with North America and strengthening them with South American countries and US adversaries, most notably President Mahmoud Ahmadinejad in Iran. Yet the country has not succumbed to the violent drug gangs and Marxist guerillas roiling its neighbors, but crime, corruption and border disputes are persistent threats to stability in Ecuador. What assurance, some worry, is there that a troubled country that has reneged on its financial commitments in the past would not simply take the money from the Yasun? Initiative and drill for oil anyway?

Bad blood between Ecuador and US oil companies stems from environmental disasters caused by past oil drilling in the Amazon. Texaco (now a part of Chevron) is still in litigation over oil drilling in Ecuador beginning in 1964. Indians and settlers allege that the documented high rates of cancer and miscarriages that they are suffering are direct results of the intentional dumping of 68 million liters of crude oil into the rainforest?30 times more oil than was spilled in the Exxon Valdez disaster in 1989.

It?s not just the oil

?The question of conservation in Yasun? is not as simple as saying we are not going to drill?oil is not the problem.? Navarrete notes that there is no oil in the eastern side of the park ?and almost everything is devastated.? The destruction of the forest there is caused by expansion for banana and oil palm plantations, pasturelands, road building, settlements, and illegal hunting and logging. The destruction is amplified as indigenous people become less isolated and acquire chain saws and other modern technology that are incompatible with their ancient nomadic way of life. The new taste for modern commodities, clothes, shoes, and mechanized equipment, creates a new demand for money, setting up a vicious cycle of harvesting the forest to sell for currency. ?If you want to preserve this pristine forest you definitely have to solve the poverty problem.?

Sitting at his desk in Quito, Professor Carlos Larrea, an ?Ecological Economist? at the Universidad Andina, Sim?n Bol?var, scratches out mathematical calculations using matrix algebra to model ecological and economic dynamics. ?It is an unusual mix?, he says explaining his unique professional expertise, but by definition conservation lives at the intersection of science and politics. ?The Initiative began with scientists,? he says, and Larrea has been a leader in the effort since the beginning.

?Ecuador has the largest undisturbed ecological system in South America. 20% of Ecuadorian land is protected. In spite of everything, the deforestation rate is the second highest in South America,? Larrea says. ?This is why we need to stop deforestation not only in the park, but on a national level.?

With pride Larrea says that recently there has been a major achievement in efforts to save the Yasun?. On December 20, 2011, Ivonne Baki, representative for the Yasun? Initiative announced that President Rafael Correa decided to continue the Initiative though 2013 rather than begin drilling for oil, the so called ?Plan B?, which is being plotted in parallel should the Initiative fail. The decision came after reaching the goal of obtaining 100 million dollars in pledge money from foreign countries by the end of the year. Next year, however, the ante raises to 291 million to forestall drilling. But will the developed world pony up?

?Pie in the sky?it will never happen,? a geologist and oil company executive predicted. ?American oil companies know how to extract the oil in an environmentally safe manner, and the income would lift the people of Ecuador out of poverty.?

Safe Drilling?

The environmental standards and technology for oil extraction have advanced greatly in 50 years since Texaco drilled and spilled oil in the Amazon jungle. For example, the HRT Oil Company, in alliance with Russia?s TNK-BP and the state-run Petrobras, are drilling for oil in virgin rainforest in Brazil. The corporations use helicopters to fly workers and drilling equipment to the sites instead of cutting roads, and they lay flexible oil pipelines to circumnavigate sensitive vegetation.

?I think it is very risky.? Larrea cites the example of British Petroleum?s disastrous spill in the Gulf of Mexico. ?It took more than 4-6 months just to cap it. BP has the best technology and standards in the industry, and they had an accident they never thought was even possible, which produced the largest oil spill in American history.?

Moreover, Larrea says that the unique geology in the Yasun? presents unique problems for oil extraction because of the large volume of water (95% or more) that is extracted with the oil. In regions adjoining the park the water pollution associated with oil extraction is a serious problem. ?The environmental risk is too high.?

?Can?t live in the past?

With more than 24 peaks lofting over 4,200 m, the high Andes Mountains in Ecuador contribute to the country's diversity of habitats.

Many feel that preserving the way of life of the indigenous people in the Amazon is as important as preserving the native plants and animals there, but in fact, this is part of the problem in the multifaceted challenge of preserving the Yasun?. ?It is very romantic,? Navarrete admits, to imagine the Indians living harmoniously with nature in the Yasun? Forest, ?but it is impossible to continue with that way of living.? He asks whether it is right to deny the Indians, who suffer a 50% infant mortality rate, access to immunization and modern medicine? But ?If they take the medicine, their culture dies,? Navarrete says, because it undermines their traditional culture of reliance on Shamans and natural remedies. Moreover, the humane benefits of medicine increase deforestation because lowering the death rate increases pressure on the rainforest, by upsetting a centuries-old balance between the needs and practices of a small number of nomadic tribes harvesting game and using slash-and-burn farming to survive in the jungle. ?In the past they died of horrible diseases and only lived about 40 years, but now they can live to their 70?s.

The problems developing countries are now struggling with are the same ones that industrialized countries faced over a century ago. ?It is very important to learn from the past not only in the USA but Argentina, to avoid the mistakes of the past,? says Navarrete. Virgin forests are scarce in the US and Europe, having been exploited for development. Habitats were destroyed, even though protected inside treasured national parks, as in the flooding of Hetch Hetchy Valley in Yosemite National Park to provide drinking water for San Francisco. More than a century after the gold rush, the sediments of San Francisco Bay remain polluted with mercury from the mining. Fisheries have collapsed and species driven to extinction. Indigenous populations in America were dominated and displaced often brutally. ?It is impossible,? Navarrete says, to follow the American example in dealing with their indigenous peoples. ?Here the mixture between Spaniards and indigenous people is deeper than in the states. It is difficult to go against yourself in that way.?

Preserving biodiversity through tourism. Designated a World Heritage Site by UNESCO in 1978, the ancient city of Quito provides an opportunity to exploit Ecuador's rich cultural and biological diversity by switching from an oil-based economy to an economy based on tourism.

Today there is an understanding of the serious and long-lasting costs of environmental destruction, and an appreciation that environmental damage can become a global problem. Pesticide runoff from rice paddies in China finds its way through the food chain into a can of tuna in your supermarket. Carbon dioxide and pollutants released into the air can taint the global atmosphere, regardless of its source. The extinction of rare species in the Amazon jungle, including possible new sources of pharmaceuticals from exotic plants, is a permanent loss for the world as a whole. The global consequences of promoting development in underdeveloped countries are the reasons why the Yasun? Initiative looks to the industrialized world to share in the solution to the problems of development in the Amazon.

The 3.6 billion requested is equal to the amount of carbon dioxide (400 million tons) that would be generated by burning the amount of oil in the Yasun? reserves. Based on the current price for carbon offsets this would be worth 8 billion dollars. ?Even without taking into consideration the other benefit of avoiding deforestation, which is actually much higher,? Larrea says. According to his calculations, 8 billion dollars is approximately the same value to the government as if they exploited the 859 million barrels of oil. The plan asks the developed world to meet Ecuador half way in the costs.

?We need to figure out new ways of getting better living standards at the same time preserving cultural diversity an biodiversity,? he says.

Moving to a post oil economy

The money from the Yasun? Initiative would be used to develop a sustainable future while protecting the Amazon forest. ?We need to think about sustainability.? To do that, Larrea proposes giving up the most lucrative source of income Ecuador currently has.

Larrea advocates, ?Shifting from an economy based mostly on oil extraction towards a new kind of development model which can be compatible with sustainability and equity.? Regardless, he says, there is no other choice. ?The oil will be gone in about 20 years, even if we take the [Yasun?] reserves. In fact, oil extraction in Ecuador has been in decline.? Last year Ecuador exported 25% less oil than in 2004, he says. ?We have to move toward a long-term strategy and a post oil economy. We have 15-20 years [to do it].?

Larrea?s plan is to exploit Ecuador?s most valuable, but untapped asset: its biodiversity. ?We cannot become a highly competitive country in terms of manufacturing and production in 10 or 20 years. It takes much more time.? The growing industry of ecotourism and cultural tourism is the answer he feels. He points to Costa Rica, which is an even smaller but more prosperous country, where 7% of the country?s employment is provided by tourism compared with 1.5% in Ecuador. In addition to its unmatched biodiversity, Ecuador has several other advantages for developing tourism. ?We don?t? have the violence of guerillas as in Columbia, or the violence that you can see in Peru or Mexico.? The opportunities for cultural tourism are also strong. The city of Quito, established by the Spanish in the 1500s in an area occupied by Indians for thousands of years, was designated a World Heritage Site by UNESCO in 1978, the first city in the world to receive such status.

Agreeing that ecotourism is part of the solution, Navarrete believes the problem is too big to be solved by tourism alone. Sustainable production of timber, fishing, and other industry will be necessary, but ecologists are against introducing foreign species, such as Monterrey pine and eucalyptus, into the rainforest for logging. ?What about the ecological effects of the expanding pastures with cattle that are there now,? he asks? Development must be managed wisely, he says, just as with tourism. Between 2007 and 2010 UNESCO added the Gal?pagos Islands to the the list of World Heritage in Danger because of rampant tourism. Despite the pressures on it, satellites show that the Yasun? Park is still 90% undisturbed, according to Larrea.

What?s it worth?

To put the 3.6 billion dollar price tag of the Yasun? Initiative in perspective, consider that British Petroleum has set aside 37.2 billion to resolve litigation resulting from the 4.9 million barrels of oil that spewed from their damaged well in the Gulf of Mexico?ten times the amount requested to save the Yasun? Forest. Facebook expects to raise $5 billion in its IPO stock offering, and analysts put Facebook?s value at 125 billion in its business selling ads targeted to its users. The Defense Department has already spent $330 million, more than next year?s goal to preserve the Yasun?, to develop a more powerful bunker busting bomb to drop on Iran.

Will the plan succeed?

Professor Carlos Larrea, one of the architects of the Yasuní Initiative, in his office at the Universidad Andina Simón Bolívar, in Quito, explaining the plan to trade 3.6 billion dollars in return for not extracting oil from the Yasuní preserve.

Professor Carlos Larrea, one of the architects of the Yasun? Initiative, in his office at the Universidad Andina Sim?n Bol?var, in Quito, explaining the plan to trade 3.6 billion dollars in return for not extracting oil from the Yasun? preserve.

What assurance is there that oil companies will not exploit the oil someday, and what is there to keep President Correa or a future President from reneging on the promise after receiving the 3.6 billion? ?I don?t think it is impossible, however we have binding international agreements signed with the UN, and there is a political reason and an economic difficulty to do so,? Larrea says.

?If any government in the future decides to exploit the oil they must first return the contribution,? he explains.

However, this may create a disincentive for companies to contribute to the initiative. In her announcement on December 20, Ivonne Baki, noted that ?not a single contribution from Chevron,? had been received toward reaching the 100 million goal.?

Nevertheless, Larrea predicts that ?It will be in the future increasingly difficult for governments to extract oil.? According to a recent poll, 83% of the Ecuadorian population is against drilling for oil in Yasun? Park, despite the poverty they suffer and the economic benefit oil drilling would bring. In Germany, 120 thousand letters were sent to parliament by German citizen in support of the Yasun? Initiative. ?We don?t expect the US government to help, given the problems we see in congress. This is not going to be discussed in the Senate, but it will be discussed in society,? Larrea says. ?We want to work with private citizens, states, NGOs, to promote the initiative.? The Initiative has begun accepting tax-deductable donations from private citizens through its website www.Yasun?support.org.

Will the initiative succeed? ?I think so,? Larrea says. ?We have been successful, particularly in making the Yasun? Park an issue world-wide. This already is a very important success.? Until recently, almost no one knew of the Yasun? Park, he observes. A slight smile of pride surfaces momentarily on the professor?s face. ?It is impossible to predict the future, but success doesn?t necessarily mean that there will not be drilling in the future,? he says despite his concerted effort to stop it. Awareness has been raised internationally to the problems of conservation in developing countries, and this has brought recognition that the costs, and the losses, are shared globally.

As if solving a complex multivariate equation, the enormously complex problem entangling ecological, economic, social, and geopolitical factors has been reduced to one simple solution: 3.6 billion. Now that the Initiative has sidestepped impediments imposed by governments and corporations, every citizen of the US and Europe can act independently to save the Yasun? through a website donation if they so choose. Call it a ?Scheherazade solution,? but if the world calls the Ecuadorian President on his bet, the destruction the Yasun? rainforest can be saved from destruction for one more year, and then another, and possibly indefinitely.
